A recent English court decision in W Ltd v M SDN BHD1 has refused to follow the IBA Guidelines on Conflicts of Interest in International Arbitration (IBA Guidelines)2 and has dismissed a challenge to an arbitrator despite the fact that the situation fell fairly and squarely within the Non-Waivable Red List.
